Ramsey v. Board of Education

ACK obtained a voluntary dismissal with prejudice in Ramsey v. Board of Education, et al.  Plaintiff, a Delaware resident, brought this action in the Superior Court of Delaware for New Castle County sounding in negligence and premises liability for alleged exposure to asbestos while working construction at a school in Crisfield, Maryland, which is located in Somerset County.  The Board sought dismissal of these claims on the grounds that plaintiff's chosen forum lacked personal jurisdiction over the Board.  Unable to overcome this meritorious position, the plaintiff voluntarily dismissed his claims against the Board with prejudice.
