Henderson, et al. v. Evans, et al.

Representing the Board of Education of Baltimore County, ACK won on appeal in Henderson, et al. v. Evans, et al.   The case arose from the May 2004 shooting at Randallstown High School in Baltimore County.  Plaintiffs sued the school principal, the Baltimore County Board of Education, the county police department, two police officers and the shooters in Circuit Court of Maryland for Baltimore City.  A Baltimore City judge transferred this action to Baltimore County on the basis of forum non conveniens.

On appeal, Plaintiffs argued that the trial court abused its discretion by transferring the case from Baltimore City.  Affirming the trial court's ruling, the Court of Special Appeals held that the trial court acted well within its broad discretion by determining that the balance of evidence weighed strongly in favor of transferring this action to Baltimore County.
